I3 87 octane tune no good reinstalled backup no good

I received a brand new I3 last week under warranty, so a little while ago I went to install the 87 octane tune and start the Lew process all over again.

Updated the I3 then went to the truck and installed the tune with firm shift. Backup went well, tunes installed complete.

I sensed something was wrong again because the "reduced engine power" message was still on when the I3 was finished. So like before, sure enough, I read the codes and got the same trouble codes all over again.

I tried clearing them with the 87 tune installed. No dice.

I reinstalled the original backups, and there again, there was the "reduced engine power message."

I tried clearing the codes, the I3 said they were cleared, but still got the message, and the truck would hardly run.

Finally, after 5 attempts, the codes cleared and the truck is back to normal.

I know little about all this stuff. The truck is still under warranty. Last time I was in to the dealer they told me nothing was wrong.

Do I:

1) Tell the dealer I had these codes and had "the auto parts store" clear them so I could bring the truck in?

2) Deliberately "fail" the truck by installing the 87 octane tune, then restoring the backup and leaving the codes, and have the truck towed in?

Or, is there a third option?

I'm thinking either the ECM is bad or is faulty, but the dealer won't do anything if there are no codes, and obviously, Lew is out of the question right now.
